Attention Health Care Clients

 

The Utah State Legislature recently passed legislation that may impact your business. As your collection partner, we are making every effort to work with our clients to implement any necessary changes.

We have compiled some helpful information for you and strongly urge you to review the new as well as your own billing practices to ensure you are in compliance.

What is the bill?

The Healthcare Debt Collection Amendments (H.B. 128, 2017 Legislative Session).
The bill modifies and enacts provisions related to healthcare claims practices and enacts new rules for healthcare providers who report delinquent debt to a credit bureau or use the services of a collection agency.

When does the new law go into effect?

The law will be effective on May 9, 2017.

How will this impact your business?

Health care providers may not report to credit bureaus or assign a claim to a collection agency until after the expiration of the time afforded to an insurer to determine the insurer's obligation to pay or deny the claim without penalty.

Health care providers must send a Notice that states the amount the insured owes and the date by which the insured must pay the amount owed (45 days after the date of the notice, 60 days for medicare beneficiaries and retirees).

If the insured fails to pay the amount timely, the health care provider may make a report to a credit bureau or use the service of a collection agency.

There may be fines and penalties assessed by the Division of Occupational and Professional Licensing or the Department of Health for violations.  We strongly urge you to review the text of the legislation and to seek the advice of your legal counsel to assist you in implementing any necessary changes.
